Multistate Essay Examination

The Multistate Essay Examination (MEE) is made up of several essay questions drafted by the National Conference of Bar Examiners. The MEE is administered in 27 jurisdictions (including Arkansas, District of Columbia, and U.S. Territories). A subject matter outline is available from the National Conference of Bar Examiners. The National Conference of Bar Examiners writes nine questions each time the bar exam is administered and each jurisdiction determines how many of the nine questions it will use. The National Conference of Bar Examiners, which drafts the MEE, publishes a free informational booklet on the MEE. Applicants are given 30 minutes to complete each question.

In Arkansas, six of the nine MEE questions are administered the afternoon of the first day of the bar exam and accounts for 25% of the overall bar exam score. Information concerning the Arkansas bar exam, rules, and application process is located on the official website of the Arkansas State Board of Law Examiners. Note that although the MEE is written by a national organization, applicants’ responses are graded by the Arkansas Board of Law Examiners. In Arkansas, the average minimum passing score on each question is 75.

In Arkansas, the following subject areas are tested by the MEE:

  • Business Association (agency, partnership, corporation, LLC)
  • Conflicts of Law
  • Constitutional Law
  • Contracts (Sales)
  • Criminal Law/Procedure
  • Evidence
  • Equity and Domestic Relations
  • Federal Civil Procedure
  • Real Property
  • Torts
  • Trusts and Estates
  • Uniform Commercial Code (Secured Transactions)

The NCBE subject matter outlines provide additional information concerning the specific areas commonly tested for each area. The Arkansas State Board of Law Examiners provides a very general description of these topics on its website. In addition, the board posts previous examination questions and top answers on its website. These previous questions and top answers are also available on reserve in the law school library.
