Assignment of Copyright (Limited)
1 Use of UALR Institute of Government’s SRC Data and/or Information by Researchers not Affiliated with UALR and any or all Research Based on Materials subject to Copyright by UALR. The UALR Institute of Government’s SRC Archive is available for use, based on the terms set forth herein, for researchers not affiliated with UALR. The SRC is part of the Institute of Government, which is a constituent part of the College of Professional Studies. Electronically readable data and codebook files in use by Researchers not affiliated with UALR must receive permission from UALR and/or UALR Institute of Government’s SRC. Any dissemination of these data available through UALR Institute of Government’s SRC to persons not affiliated with the university, i.e., not a current faculty member or current student, constitutes a violation of copyright; any resulting products using information from UALR Institute of Government’s SRC is then considered in violation of applicable copyright and will be recalled and halted by the university.
3 Manuscripts or research using the UALR Institute of Government’s SRC data and/or information are guided by the terms of this agreement and are only permitted when such agreement has been reached between UALR and all researchers associated with research in any form.
4 Permission to use information is extended only to the limited use of the current research as specified below; this limited permission shall apply to this research only (as specified) for a period not to exceed four years. These materials can only be used as provided in these terms. This agreement applies to:

5 All or any subsequent work from data derived or originating from the UALR Institute of Government’s SRC is expressly prohibited and is a violation of all existing and future applicable copyright laws and policies as set forth herein, by the University, or the Institute of Government.
6 Any and all files, data, or information from the UALR Institute of Government’s SRC may not be redistributed outside UALR in any form without prior permission from the university and/or UALR Institute of Government’s SRC.
7 All or any dissemination or sharing of data derived or originating from the UALR Institute of Government’s SRC is prohibited.
8 In signing this Agreement:
a You hereby warrant that this Research is an original work, has not been published before and is not being considered for publication elsewhere in its final form either in printed or electronic form;
b You hereby acknowledge that data derived from the UALR Institute of Government’s SRC are not used for any further purposes and are applicable to the present research project only (as noted above) and this agreement does not cover any subsequent research beyond that stated herein;
c You hereby warrant that you have obtained permission from the copyright holder to reproduce in the Research (in all media, which includes but is not limited to print and electronic form) material not owned by you, and that you have acknowledged the source;
d You hereby warrant that this Research contains no violation of any existing copyright or other third party right or any material of an obscene, indecent, libelous or otherwise unlawful nature and that to the best of your knowledge this Research does not infringe the rights of others;
e You indemnify and keep indemnified any UALR entity and/or affiliated UALR entities affected by this agreement against all claims and expenses (including legal costs and expenses) arising from any breach of this warranty and the other warranties on your behalf in this Agreement.
9 Any profits, or remuneration derived from such publication must remain with, or be assigned to the UALR Institute of Government.
10 Any use by any organization, person, or party, i.e., those individuals or organizations with no affiliation to UALR, research and scholarly publications, use of the UALR Institute of Government’s SRC information or data under these terms by scholars, news or magazine articles, and radio or television broadcasts, or any other mode of dissemination, whether involving data analysis and conclusions based on said analysis appearing in any publication, using summaries and/or information based on data made available in the public domain (i.e., information made available to the general public and without restricted access) from the UALR Institute of Government’s SRC must acknowledge the origin of this information or these data through appropriate citation or recognition. For example, for scholarly publications, we suggest: “Data upon which this research is based are from the UALR Institute of Government’s Survey Research Center & Institute on Race and Ethnicity, Little Rock, Arkansas, ‘Annual Survey Study Title,’ year.”; for print and broadcast media, we suggest: “The information is based on results provided from the UALR Institute of Government’s Survey Research Center & Institute on Race and Ethnicity, Little Rock, Arkansas, or some similar attribution acknowledging UALR and the Institute of Government’s Survey Research Center & the Institute on Race and Ethnicity .
11 Use of information or data from the UALR Institute of Government’s SRC is granted on a limited basis for research and educational purposes only and shall include only:
a The Research specifically as noted above (see 5a);
b The Researcher(s) only as noted above (see 5b&c);
c The copyright for the Research, which includes the abstract for the full period of copyright and all renewals, extensions, revisions and revivals throughout the world in any form and in all languages (see 5a&d);
d The data and any derivations of the data upon which this research is based cannot be reproduced and shared without express written permission from UALR and/or the UALR Institute of Government’s SRC; and,
e The rights only granted in this Agreement.
12 Indemnity of the University, the Institute of Government, the Institute of Government’s Survey Research Center and the Institute on Race and Ethnicity data and information or electronic files are offered “as is” with no warranty or claim of suitable work product and UALR is not responsible for interpretations resulting from the use of information for any purpose. No rights and privileges transfer with use of data and/or information. In no event shall the University, nor any of its constituents, be held liable for any actual, incidental or consequential damages stemming from use of data and/or information based on information from UALR . Any individual or any organization is prohibited from releasing information from a survey (or surveys) in any form unless noted herein. If there is any misrepresentation of these data collected by the UALR Institute of Government’s SRC as deemed by the university, the UALR Institute of Government’s SRC reserves the right to publicly correct this information. If, in the judgment of the UALR Institute of Government’s SRC, the data collected in a study are misrepresented, the UALR Institute of Government’s SRC, as owners of these data, retains the right to issue a public correction and make any other amends, public or private, to remedy such misrepresentation. Under no circumstances may any data from the UALR Institute of Government’s SRC be used in paid advertising or any paid promotion without prior written consent; any such use in which remuneration in any form is provided, all sources of remuneration or an agreed upon cash value must be conveyed in full to the UALR Institute of Government without penalty.
13 If there is any question about the use of information from the UALR Institute of Government’s SRC, or about the information being used by third parties that, through such use acknowledges and accepts the rules and policies governing use of this information, please contact the UALR Institute of Government for further information about applicable copyright laws.
