If you are a pregnant or parenting student, UA Little Rock has resources to help you.<\/p>\n\n\n\n<p>Here is a video on Pregnancy, Parenting, and Related Conditions filmed on March 28, 2024 by Director of Title IX, Emily Bell.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Title IX Talks: Pregnancy, Parenting, and Related Conditions\/Spring 2024\" width=\"1778\" height=\"1000\" src=\"https:\/\/www.youtube.com\/embed\/1Gc2VvKyl6U?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p> <\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-title-ix-and-pregnancy\">Title IX and Pregnancy<\/h2>\n\n\n\n<p>The Title IX regulation, at 34 C.F.R. \u00a7 106.31(a), states as follows: \u201c<em>Except as provided elsewhere in this part, no person shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any academic, extracurricular, research, occupational training, or other education program or activity operated by a recipient which receives Federal financial assistance.<\/em>\u201d<\/p>\n\n\n\n<p>Specifically, Title IX prohibits discrimination against a student based on pregnancy, childbirth, false pregnancy, termination of pregnancy, or recovery from any of these conditions. Title IX also ensures the right to take medically necessary leave and to be free of harassment, intimidation, or other discrimination because of pregnancy-related conditions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-does-this-mean-for-you-as-a-student\">What does this mean for you as a Student?<\/h2>\n\n\n\n<p>Students must be allowed to take time off of school for pregnancy, childbirth, miscarriage, abortion, and\/or recovery for as long as their doctor says is medically necessary. That could mean a few absences for necessary medical appointments or a longer leave of absence for a high-risk pregnancy or childbirth. This rule applies even if taking medically necessary leave would require an absence for longer than the school\u2019s leave policy ordinarily allows. Students cannot be penalized for taking leave and must be able to return to school in the same status they held before taking leave.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-frequently-asked-questions-for-students\">Frequently Asked Questions for Students<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-where-can-a-student-seek-assistance-for-pregnancy-related-accommodations\">Where can a student seek assistance for pregnancy-related accommodations?<\/h3>\n\n\n\n<p>The <a href=\"https:\/\/ualr.edu\/disability\/\">Disability Resource Center<\/a> (DRC) provides adjustments\/accommodations for students experiencing pregnancy-related medical complications. If you are a student who is pregnant and experiencing pregnancy-related medical complications and needs assistance with adjustments\/accommodations, contact the DRC at 501-916-3143 or disability@ualr.edu.<\/p>\n\n\n\n<p>The <a href=\"https:\/\/ualr.edu\/titleix\/\">Office of Title IX<\/a> (Title IX) assists pregnant students who are not experiencing pregnancy-related medical complications requiring pregnancy-related adjustments\/accommodations or who have given birth and continue to require adjustments\/accommodations. If you are a pregnant student not experiencing pregnancy-related medical complications or have given birth and need assistance with adjustments\/accommodations, contact Title IX at 501-916-5716 or titleix@ualr.edu.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-are-some-examples-of-possible-accommodations-i-can-request\">What are some examples of possible accommodations I can request?<\/h3>\n\n\n\n<p>Under Title IX of the Education Amendments of 1972, you are entitled to reasonable accommodations. The Office of Title IX works directly with the Disability Resource Center to ensure that accommodations are in place for students who are experiencing pregnancy, parenting, and related conditions.<\/p>\n\n\n\n<p><strong>Examples of possible reasonable accommodations are:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Excused absences due to pregnancy or related condition<\/li>\n\n\n\n<li>Reviewing lectures online if available<\/li>\n\n\n\n<li>Opportunity to make up field\/lab work<\/li>\n\n\n\n<li>Rescheduling of tests or exams<\/li>\n\n\n\n<li>A larger desk<\/li>\n\n\n\n<li>Breaks during class, as needed<\/li>\n\n\n\n<li>Submitting work after a deadline missed due to pregnancy or childbirth<\/li>\n\n\n\n<li>Providing alternatives to make up missed work<\/li>\n\n\n\n<li>Assignment of an Incomplete * grade<\/li>\n\n\n\n<li>Allowing \u201cWithdrawal\u201d * with a refund<br><br>*If a student is eligible<\/li>\n<\/ul>\n\n\n\n<p>If you would like to review possible reasonable accommodations contact the Title IX Office for further information. <em>If you are a faculty or staff member and require workplace accommodations related to pregnancy or pregnancy-related conditions, contact Human Resources.<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-pregnancy-childbirth-and-related-conditions-may-necessitate-absences-will-those-absences-be-excused\">Pregnancy, childbirth, and related conditions may necessitate absences. Will those absences be excused?<\/h4>\n\n\n\n<p>Yes. Absences due to pregnancy, childbirth, or related medical conditions must be excused and cannot be treated or penalized like unexcused absences.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-what-happens-when-a-pregnant-student-misses-assignments-tests-exams-etc-due-to-an-excused-absence\">What happens when a pregnant student misses assignments, tests, exams, etc. due to an excused absence?<\/h4>\n\n\n\n<p>After an excused absence due to pregnancy, childbirth, or any related medical conditions, professors must allow a reasonable time for the student to make up missed assignments and tests. This is true regardless of the professor\u2019s typical makeup assignment policy.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-can-pregnant-students-be-penalized-for-their-absence-if-grades-in-a-class-are-based-on-attendance-or-participation\">Can pregnant students be penalized for their absence if grades in a class are based on attendance or participation?<\/h4>\n\n\n\n<p>A student may not be penalized for absences known to be due to pregnancy, childbirth, or other related medical conditions. A professor cannot reduce a pregnant student\u2019s grade because of attendance or participation points that the student missed during excused absences due to her pregnancy-related conditions.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-can-a-pregnant-student-participate-in-internships-and-other-off-campus-programs\">Can a pregnant student participate in internships and other off-campus programs?<\/h4>\n\n\n\n<p>Yes. Pregnant students cannot be excluded from University-related off-campus programs, such as internships, off-campus activities, University-sponsored activities, and other extracurricular activities. You may contact her from 8 a.m. to 5 p.m. Monday through Friday by phone at 501-916-5716 or by email at <a href=\"mailto:edbell@ualr.edu\">edbell@ualr.edu<\/a>.\u00a0The Title IX coordinator can assist with a variety of interim measures including no-contact orders, academic support, and housing accommodations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-filing-a-report\">Filing A Report<\/h2>\n\n\n\n<p>You are not required to file a report immediately after being subjected to sexual misconduct, and there is no statute of limitations on filing a Title IX Incident Report. Employees or students of the university who believe they have been subjected to sexual misconduct are encouraged to use the <a href=\"https:\/\/cm.maxient.com\/reportingform.php?UALittleRock&layout_id=1\">incident report form<\/a> and review <a href=\"https:\/\/ualr.edu\/policy\/home\/facstaff\/title-ix\/\">UA Little Rock’s Title IX Policy for Complaints of Sexual Assault and Other Forms of Sexual Harassment<\/a> for the university’s grievance procedures.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Once a report is received, the Title IX Coordinator will contact those named in the report.<\/li>\n\n\n\n<li>Reports and Complaints can be resolved formally or informally.<\/li>\n\n\n\n<li>Supportive Measures will be offered.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-find-confidential-support\">Find Confidential Support<\/h2>\n\n\n\n<p>Anyone who feels that they have been the victim of prohibited, sexual misconduct but does not wish to file a formal complaint can still find help. Resources are available even if an individual chooses not to file a formal complaint to law enforcement or the university.<\/p>\n\n\n\n<p>Confidential Reporters are required to provide general non-identifying information as required to comply with the Clery Act, and must report to the Title IX Coordinator any type of sex-based incident made known to them, but may not include any information that would violate that person\u2019s expectation of privacy. Members of the clergy, chaplains, and off-campus rape crisis center staff can maintain confidentiality. At the time of the filing of a formal complaint, a complainant must be participating in or attempting to participate in the education program or activity of the recipient with which the formal complaint is filed. Any person may report sex discrimination, including harassment, whether or not the person reporting is the person alleged to be the victim of discrimination or harassment.<\/p>\n\n\n\n<p><strong>Consent:<\/strong> Consent is clear, knowing, and voluntary. Consent is active, not passive. Silence, in and of itself, cannot be interpreted as consent. Consent can be given by words or actions, if those words or actions create mutually understandable clear permission regarding willingness to engage in (and the conditions of) sexual activity. If coercion, intimidation, threats, or physical force are used, there is no consent.<\/p>\n\n\n\n<p>If a person is mentally or physically incapacitated so that the person cannot understand the fact, nature, or extent of the sexual situation, there is no consent. Incapacitation can be due to alcohol or drugs or being asleep or unconscious. This policy also covers incapacity due to mental disability, involuntary physical restraint, or from the taking of rape drugs. Possession, use and\/or distribution of any of these substances, including Rohypnol, Ketamine, GHB, Brundage, etc. is prohibited, and administering one of these drugs to another person is a violation of this policy. More information on these drugs can be found at <a href=\"http:\/\/www.911rape.org\/\">http:\/\/www.911rape.org\/<\/a><\/p>\n\n\n\n<p>Use of alcohol or other drugs will never function as a defense to a violation of this policy. An individual violates this policy if the individual initiates and engages in sexual activity with someone who is incapacitated, and (1) the individual knew the other person was incapacitated, or (2) a sober reasonable person under similar circumstances as the person initiating the sexual activity would have known the other person was incapacitated.<\/p>\n\n\n\n<p>There is also no consent when there is force, expressed or implied, or use of duress or deception upon the victim. Whether an individual has taken advantage of a position of influence over an alleged victim may be a factor in determining consent.<\/p>\n\n\n\n<p>Force is the use of physical violence and\/or imposing on someone physically to gain sexual access. Force also includes overt threats, implied threats, intimidation, and coercion that overcome resistance or produce consent.<\/p>\n\n\n\n<p>Coercion is unreasonable pressure for sexual activity. Coercive behavior differs from seductive behavior based on the type of pressure someone uses to get consent from another. When someone makes clear to you that they do not want sex, that they want to stop, or that they do not want to go past a certain point of sexual interaction, continued pressure beyond that point can be coercive.<\/p>\n\n\n\n<p>Under Arkansas law, the age of consent varies with the degrees of assault, the age of the actor, and the relationship of the actor to the other party. For specific information, please refer to Arkansas statutes (e.g., Arkansas Code Annotated \u00a7 5-14-125, Sexual Assault in the Second Degree).<\/p>\n\n\n\n<p>Consent to any one form of sexual activity cannot automatically imply consent to any other forms of sexual activity. In addition, previous relationships or prior consent cannot imply consent to future sexual acts.<\/p>\n\n\n\n<p><strong>Dating Violence:<\/strong> Violence committed by a person who is or has been in a social relationship of a romantic or intimate nature with the victim and where the existence of such relationship is determined based on consideration of the following factors: (1) the length of the relationship; (2) the type of relationship; and (3) the frequency of interaction between the persons involved in the relationship.<\/p>\n\n\n\n<p><strong>Days: <\/strong>Refers to working days, rather than calendar days, unless otherwise specified.<\/p>\n\n\n\n<p><strong>Domestic Violence:<\/strong> The term includes felony or misdemeanor crimes of violence committed by a current spouse or intimate partner of the victim, by a person with whom the victim shares a child in common, by a person who is cohabitating with or has cohabitated with the victim as a spouse or intimate partner, by a person similarly situated to a spouse of the victim under the domestic or family violence laws of Arkansas, or by any other person against an adult or youth victim who is protected from that person\u2019s acts under the laws of Arkansas. Under the Arkansas law on domestic abuse, \u201cfamily or household members\u201d means spouses, former spouses, parents and children, persons related by blood within the fourth degree of consanguinity, in-laws, any children residing in the household, persons who presently or in the past have resided or cohabitated together, persons who have or have had a child in common, and persons who are presently or in the past have been in a dating relationship together.<\/p>\n\n\n\n<p><strong>Education Program or Activity:<\/strong> Includes locations, events, or circumstances over which the University exercised substantial control over both the respondent and the context in which the sexual harassment occurred, and also includes any building owned or controlled by an officially recognized student organization.<\/p>\n\n\n\n<p><strong>Formal Complaint: <\/strong>A document filed by a complainant or signed by the Title IX Coordinator alleging sexual harassment against a respondent and requesting that the recipient investigate the allegation of sexual harassment. The phrase \u201cdocument filed by a complainant\u201d means a document or electronic submission (such as by electronic mail or through an online portal provided for this purpose by the University) that contains the complainant\u2019s physical or digital signature, or otherwise indicates that the complainant is the person filing the formal complaint.<\/p>\n\n\n\n<p><strong>Party:<\/strong> The complainant or respondent.<\/p>\n\n\n\n<p><strong>Preponderance of the Evidence: <\/strong>A standard of proof where the conclusion is based on facts that are more likely true than not.<\/p>\n\n\n\n<p><strong>Respondent:<\/strong> An individual who has been reported to be the perpetrator of conduct that could constitute sexual harassment.<\/p>\n\n\n\n<p><strong>Sanctions: <\/strong>The determination of sanctions to be imposed against a respondent who is found to have been responsible for violating this policy will depend upon the nature and gravity of the misconduct, any record of prior discipline for a violation of this Policy, or both. Sanctions against students may include, without limitation, expulsion or suspension from the University, disciplinary probation, expulsion from campus housing, mandated counseling, and\/or educational sanctions. Sanctions against employees and other non-students may include, without limitation, a written reprimand, disciplinary probation, suspension, termination, demotion, reassignment, revision of job duties, reduction in pay, exclusion from campus or particular activities, and\/or educational sanctions deemed appropriate.<\/p>\n\n\n\n<p><strong>Sexual Assault:<\/strong> The term \u201csexual assault\u201d means an offense classified as a forcible or nonforcible sex offense under the uniform crime reporting system of the Federal Bureau of Investigation. A nonforcible sex offense includes incest (<em>i.e<\/em>., the nonforcible sexual intercourse between persons who are related to each other within the degrees wherein marriage is prohibited by law) and statutory rape (<em>i.e<\/em>., nonforcible sexual intercourse with a person who is under the statutory age of consent). A forcible sex offense is any sexual act directed against another person, without the consent of the victim including instances where the victim is incapable of giving consent. A forcible sex offense includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Forcible rape<\/strong>: the penetration, no matter how slight, of the vagina or anus with any part of the body or object, or oral penetration by a sex organ of another person, without the consent of the victim.<\/li>\n\n\n\n<li><strong>Forcible sodomy<\/strong>: Oral or sexual intercourse with another person, forcibly and\/or against that person\u2019s will or not forcibly or against that person\u2019s will in instances where the victim is incapable of giving consent because of his\/her youth or because of his\/her temporary or permanent mental or physical incapacity;<\/li>\n\n\n\n<li><strong>Sexual assault with an object<\/strong>: Using an object or instrument to unlawfully penetrate, however slightly, the genital or anal opening of the body of another person, forcibly and\/or against that person\u2019s will or not forcibly or against that person\u2019s will in instances where the victim is incapable of giving consent because of his\/her youth or because his\/her temporary or permanent or physical incapacity.<\/li>\n\n\n\n<li><strong>Forcible fondling<\/strong>: The touching of the private body parts of another person for the purpose of sexual gratification, forcibly and\/or against that person\u2019s will or not forcibly or against that person\u2019s will in instances where the victim is incapable of giving consent because of his\/her youth or because his\/her temporary or permanent or physical incapacity.<\/li>\n<\/ul>\n\n\n\n<p><strong>Sexual Harassment:<\/strong> Sexual harassment is conduct on the basis of sex constituting one of the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An employee of the University conditioning the provision of an aid, benefit, or service of the institution on an individual\u2019s participation in unwelcome sexual conduct;<\/li>\n\n\n\n<li>Unwelcome conduct determined by a reasonable person to be so severe, pervasive and objectively offensive that it effectively denies a person equal access to the University\u2019s educational programs or activities; or<\/li>\n\n\n\n<li>Any of the following:\n<ul class=\"wp-block-list\">\n<li>\u201cSexual assault\u201d as defined in 20 U.S.C. 1092(f)(6)(A)(v) and this policy<\/li>\n\n\n\n<li>\u201cDating violence\u201d as defined in 34 U.S.C. 12291(a)(10) and this policy<\/li>\n\n\n\n<li>\u201cDomestic violence\u201d as defined in 34 U.S.C. 12291(a)(8) and this policy<\/li>\n\n\n\n<li>\u201cStalking\u201d as defined in 34 U.S.C. 12291(a)(30) and this policy<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p><strong>Stalking: <\/strong>Engaging in a course of conduct directed at a specific person that would cause a reasonable person to fear for his or her safety or the safety of others or suffer substantial emotional distress.<\/p>\n\n\n\n<p><strong>Supportive Measures: <\/strong>Non-disciplinary, non-punitive individualized services offered as appropriate, as reasonably available, and without a fee or charge to the complainant or respondent before or after the filing of a formal complaint or where no formal complaint has been filed. This training will help faculty and staff to understand their role as a \u201cMandated Reporter\u201d and their requirements to report instances of sexual harassment or discrimination against students and colleagues. The training should take approximately 1 hour and 50 minutes and may be completed in multiple sessions. These training modules are offered through Workday Learning.<\/p>\n\n\n\n<p>Employees should complete the required training modules \u201c<strong>Clery Act and Title IX,\u00a0 Title IX Policy, and Website Review and Acknowledgement<\/strong>.” In addition to this training, there are other optional courses available for employees that may be taken by accessing \u201cExtra Training\u201d. <\/p>\n\n\n\n<p><strong>Title IX Policy and Website Acknowledgement<\/strong><\/p>\n\n\n\n<p>Employees are expected to read and acknowledge through the online training module, the university\u2019s Title IX Policy and Website. The Title IX website provides resources, contact information, and an online incident reporting option. All required training is automatically assigned through the online training program. You will receive email reminders until the required training is completed. At the conclusion of each training course, you will have the option to print a certificate. As part of UA Little Rock\u2019s ongoing and continuous commitment to campus well-being, we are providing an online training program designed to inform participants about sexual harassment, sexual violence, and bystander intervention, as well as providing on-campus, local, and national resource information. It is our responsibility as a university community to work toward eliminating these types of behaviors and actions, and to do so, we must be well informed.<\/p>\n\n\n\n<p>To support these efforts and further our commitment, UA Little Rock offers online training for our students through Workday Learning that will satisfy the federal requirements as mandated by the Violence Against Women Reauthorization Act of 2013\/2022 (VAWA) and Title IX.<\/p>\n\n\n\n<p><strong>UA Little Rock expects you to complete the training in an effort to increase your knowledge and awareness surrounding this subject. This training should take approximately 90 minutes to complete.<\/strong> To access this training, you will need a computer with internet access and audio capabilities. If you do not have access to a computer, please utilize the student computer lab located on the first floor of the Ottenheimer Library (LIB 104). If you need assistance with the online training, please contact the Office of Title IX at <a href=\"tel:+15019163328\">501-916-5716<\/a>.<strong> To access the website, you will need your UA Little Rock email address and password, or the same information you use to access Blackboard.<\/strong> You will have the option to return to the training site at a later time if you are unable to complete the courses in one sitting. You will receive reminder emails until the required training is completed. After each training course, you will have the option to print a certificate. All training is tracked and recorded electronically.<\/p>\n\n\n\n<p>Students are expected to read and acknowledge through the online training modules, the university\u2019s Title IX Policy and Website. The Title IX website provides resources, contact information and an online incident reporting option.
