Policy

UA Little Rock employees in grievance-eligible positions may file a grievance concerning a grievable employment matter, or may otherwise enter into the dispute resolution process, according to the Employee Grievance Procedures linked below. The Employee Grievance Form is used to initiate a grievance.

Full-time, benefits-eligible positions, whether exempt or non-exempt, are grievance-eligible. Faculty positions are excluded from the definition of grievance-eligible positions.

The following are grievable employment matters under this policy:

  • Overall “unsatisfactory” performance evaluations.
  • Disciplinary actions (written warnings, performance improvement plans if disciplinary in nature, and suspensions without pay).
  • Terminations of employment for cause.

The following employment matters cannot be grieved under this policy:

  • Management decisions as they relate to wages, promotions, demotions, position assignments, or other decisions based on business needs.
  • Employee counseling sessions.
  • Any disciplinary action to the extent it is based on an employee’s falsification of documents.
  • Terminations of employment for convenience in accordance with UA Board Policy 405.4.

A grievable employment matter may be challenged only on the following grounds:

  • Procedural irregularity, including the misapplication or violation of applicable policies.
  • Discovery of new evidence that would change the outcome of the matter and that was not reasonably available at the time the matter was decided.

Allegations of discrimination, harassment, or retaliation concerning employment at UA Little Rock should be addressed to the Human Resources Department under applicable policies, such as LR 201.1 and LR 401.6.
